Halle Berry and Olivier Martinez are facing another custody court fight after a Los Angeles judge allowed their 13 year old son, Maceo, to testify about Martinez's request for a domestic violence restraining order. The judge limited the testimony to that request and ordered the hearing closed to the public. According to court documents, Martinez alleges that Berry put her hands around Maceo's neck during an argument while the boy was playing a virtual reality game. Berry denies hurting her son, while Martinez is asking for sole custody and wants Berry ordered to stay away from Maceo. What the Judge Allowed Berry had argued that Maceo should not testify because Martinez may have influenced what the teenager plans to say. Berry's court response also claims Maceo could have a personal reason to minimize his own behavior and place responsibility elsewhere, making his account something the court should examine carefully. Berry further told the court that Maceo has been pulled into adult disagreements for years, creating a parenting dynamic in which Berry becomes the disciplinarian while Martinez is viewed as the more permissive parent. The judge permitted Maceo's testimony for now, but only the parties, their attorneys, and court personnel may be present when he speaks.
