Rep. Max Miller is facing a new federal lawsuit from his ex wife, Emily Moreno , who alleges that a nude photo of their 2 year old daughter was uploaded and distributed online during Miller’s public defense against Moreno’s prior abuse claims. The complaint was filed in federal court in Ohio and also names Miller’s attorney, Aaron Minc . According to the lawsuit, Miller gave Minc a large collection of records and images intended to push back against the backlash surrounding Moreno’s allegations. Moreno claims Miller failed to check what the files contained before sharing a Dropbox folder after a livestream on X, and that posts directing people to the folder generated more than 400,000 combined views or interactions. What Is Moreno Alleging? Moreno’s attorneys allege that the image exposing the child’s genitalia remained publicly accessible for roughly 23 hours before Minc acknowledged responsibility and removed it. The complaint says the defendants have not answered questions about who may have viewed, accessed, or downloaded the image during that window. Moreno is seeking damages under federal law, with the complaint claiming Miller and Minc could face $150,000 for each disclosure or transfer of the image. Her lawyers also allege potential civil liability under Ohio law tied to alleged criminal conduct involving illegal material depicting a minor; those claims remain allegations, not court findings. Miller discussed the controversy in a CNN interview with Jake Tapper and placed responsibility for the image on Minc. Miller’s representatives had not responded to requests for comment at the time of publication, according to the report.
